Button Batteries in Toys: What to Check
A swallowed coin-sized battery can begin burning through the esophagus in about two hours, and the child often shows no obvious symptom at first. The federal rule most people have heard of applies to remote controls and key fobs — not, at present, to the toys sitting next to them.

If a button or coin battery may have been swallowed or put in a nose or ear, go to an emergency department immediately and call the National Battery Ingestion Hotline on 800-498-8666. Do not wait for symptoms, do not induce vomiting, and do not let the absence of coughing reassure you. At home, treat any battery compartment that opens without a tool as a reason to remove the toy.
What to remember
- Reese's Law (16 CFR 1263, effective 23 October 2023) requires a tool, or two independent and simultaneous hand movements, to open a button-battery compartment — on consumer products that are not toys.
- A plaything for under-14s that meets the federal toy standard is exempt from section 2 of that law. CPSC proposed adding button-cell requirements to the toy standard on 13 August 2024; no final rule had been published when this guide was checked.
- The exemption is narrow: a product age-graded 14+ is not covered by it, and a children's product that is not a plaything — light-up shoes are CPSC's example — must meet 1263 in full.
- The practical consequence: the strongest compartment rule in US law currently covers the remote control, not necessarily the toy beside it.
- Damage can begin within about two hours of a battery lodging in the esophagus, and early symptoms are easily mistaken for a cold or reflux.

Why a coin battery is not like other small parts
The hazard is chemical, not mechanical. A battery does not have to block the airway to cause serious injury.
A swallowed small part is dangerous mainly because it can obstruct. A button or coin cell is dangerous even when it passes freely: lodged against moist tissue, it generates a current that produces hydroxide at the negative pole, and that alkali burns through tissue from the outside in.
This is why the usual reassurances do not apply. A child who is breathing normally, eating, and playing can still have a battery burning in the esophagus. Early signs — drooling, refusing food, a cough, a raised temperature, irritability — look like an ordinary childhood illness, which is exactly why these injuries are so often found late.
The 20 mm lithium coin cell used in remotes, scales, thermometers, light-up novelties and many toys is the size most likely to lodge in a young child's esophagus rather than pass through.

What the federal rule actually covers — and what it does not
Reese's Law is real, current and strong. It is also aimed at the products beside the toy box rather than inside it.
Reese's Law was enacted in August 2022. The CPSC rule implementing it, 16 CFR part 1263, incorporates ANSI/UL 4200A-2023 and applies to consumer products containing button cell or coin batteries manufactured or imported on or after 23 October 2023. It requires that a battery compartment be secured so that opening it needs a tool such as a screwdriver or a coin, or at least two independent and simultaneous hand movements, and it sets warning-label requirements for the product and its packaging.
Toys are treated separately. A product designed, manufactured or marketed as a plaything for children under 14 that complies with the battery accessibility and labeling provisions of the federal toy standard, 16 CFR part 1250, is exempt from section 2 of Reese's Law. CPSC's own position when it proposed change was that the toy standard did not address all of the identified hazards and was less stringent than the rule for non-toy products.
The exemption is narrower than it first sounds, in two ways that matter at home. A product age-graded 14 and over is not a toy for this purpose and must meet the full 1263 requirements. And a children's product that is not a plaything — light-up shoes are CPSC's own example — is covered by 1263 rather than exempted. So within one household the same coin cell can sit behind three different legal standards depending on what the object is called.
On 13 August 2024 CPSC published a notice of proposed rulemaking to add button-cell performance and labeling requirements to the toy standard, with an effective date proposed at 180 days after any final rule. When this guide was checked on 13 August 2026, no final rule had been published. Check CPSC's business guidance page for the current position before relying on this paragraph.
None of that makes toys unsafe by default, and most reputable toys secure their compartments with a screw regardless of whether a rule compels it. It does mean the compartment is worth checking yourself rather than assuming a regulation has already checked it for you.

The home check
This takes about a minute per toy and is a one-way screen: it can tell you to stop, never that a product is safe.
- The riskiest items are usually not toys: remotes, key fobs, kitchen scales, thermometers, tea lights and fitness trackers all live at toddler height.
- Second-hand and hand-me-down items predate current rules and have had longer for a screw to go missing.
- A sibling's older toy reaching a younger child is the most common route in a mixed-age household, and it peaks at birthdays and Christmas.

If you think a battery has been swallowed
This is a medical emergency. Act on suspicion, not on symptoms.
Go to an emergency department immediately, and call the National Battery Ingestion Hotline on 800-498-8666 (or Poison Help on 800-222-1222) on the way. The hotline gives real-time instructions to families and to clinicians. Do not wait to see whether the child becomes unwell, do not induce vomiting, and do not give food or drink beyond what the hotline or a clinician tells you.
The same applies to a battery placed in a nose or an ear, which causes tissue damage by the same mechanism and is easily missed.
The National Capital Poison Center's triage guideline includes an interim measure for children aged 12 months and over who swallowed a battery within the previous 12 hours: 10 mL of honey every 10 minutes, to a maximum of six doses, given on the way to hospital. It is explicitly not a treatment — it slows tissue damage without preventing it, and it must never delay transport or the removal of the battery. Do not give honey to a child under 12 months, and do not give it if the battery may have been in place for more than 12 hours. Follow the hotline's instructions over anything written here.

What this means when you are buying
For a child under about six, the useful question is not whether a toy contains a coin cell but whether the compartment is secured with a screw and whether the household also contains a dozen unsecured items with the same battery in them. The toy is usually the safest object in the room; the remote is not.
Where a choice exists, a toy powered by AA or AAA cells removes the hazard rather than managing it. Where it does not, buy from sellers you can trace, so a recall or a fault has somewhere to go.
- Prefer AA/AAA power for children under six where the product category allows it.
- Check the compartment before the toy is wrapped, not after it is opened.
- Keep spare cells in their packaging, stored high, and dispose of dead ones the same day.
